Partners Wayne Gordon and Amie Fordan were successful in upholding a federal district court’s dismissal of a claim by plaintiff that a major insurance company and its attorney had violated his constitutional rights and conspired to have plaintiff unlawfully removed as the administrator of an estate in Illinois. The Fifth Circuit recently upheld the dismissal for failure to state a claim and improper venue.
Partners Wayne Gordon and Amie Fordan, along with Associate Marc Tolliver, were successful in obtaining a summary judgment in a product liability case in Dallas. The plaintiff had claimed an accident and rollover of her tractor trailer was caused, in part, by defective tires manufactured by the client. The district court ruled that plaintiff had failed to raise a fact issue on causation or on whether the company had supplied the tires in question.
