Touchstone partner Rocky Feemster recently participated in negotiating a favorable settlement for an equipment rental company that was alleged to have undertaken a faulty repair of a forklift bale clamp. While engaged in a cotton recovery process, the Plaintiff had been struck by approximately 2,000 pounds of falling cotton bales, as the hydraulic system on the bale clamp failed. The plaintiff was seriously injured and has not worked since 2008. The firm aggressively asserted the contributory negligence of the Plaintiff himself, and was able to secure a settlement on behalf of its client at a figure well less than one half of the full value of the case.
